Manly Forever Wine Promotion – Terms and Conditions

1. Acceptance of Terms:
   Information on how to enter and the prizes form part of these Terms and Conditions. By participating in this promotion, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you should not participate.
2. Eligibility:
   Entry is open only to Australian residents aged 18 years or older.
3. Ineligible Participants:
   Employees (and their immediate families) of the Promoter, Participating Venues, and agencies associated with this promotion are not eligible to enter. "Immediate family" includes spouses, ex-spouses, de facto spouses, children, step-children, parents, step-parents, grandparents, step-grandparents, uncles, aunts, nieces, nephews, brothers, sisters, step-brothers, step-sisters, or first cousins.
4. Promotion Period:
   The promotion begins on 07/07/2025 and ends at 11:59 PM AEST on 24/08/2025 (“Promotional Period”).
5. Game of Chance:
   This is a game of chance.
6. How to Enter:
   To enter, simply purchase a 6-pack of Manly Forever Reschke Coonawarra 2021 Shiraz from https://www.cwwines.com/pages/manly-forever during the Promotional Period. Each eligible purchase automatically qualifies as one entry into the draw.
7. Purchase Necessary:
   Purchase of a 6-pack of Manly Forever Reschke Coonawarra 2021 Shiraz is essential to enter the competition.
8. Entry Restrictions:
   Multiple entries are permitted. Each entry must be linked to a valid email address and purchase.
9. Verification of Entries:
   The Promoter reserves the right to verify the validity of entries and entrants (including identity, age, and residence). The Promoter may disqualify any entrant who breaches these Terms, tampers with the entry process, or engages in unlawful or improper conduct. Errors and omissions may be accepted at the Promoter's discretion. Failure to enforce any of the Promoter’s rights does not constitute a waiver of those rights.

10.  Prize Allocation and Reallocation:
CW Wines reserves the right to award prizes at its discretion and in accordance with the criteria it sets. The Promoter may amend prizes or the criteria for winning due to circumstances beyond its reasonable control, including but not limited to war, terrorism, state of emergency, pandemic, or other natural disasters. Prizes are provided by Coonawarra Wines, 4 Nelson Street, Stepney SA 5069.

If no valid entries are received from a particular state or territory, the prizes allocated to that state or territory may be reallocated to eligible entrants from other states or territories. Any such reallocation will be conducted in compliance with applicable state regulations and permit thresholds, ensuring that the total prize pool value for each state or territory does not exceed the permitted limits. The Promoter will maintain records of all reallocations and reserves the right to forfeit any prizes that cannot be reallocated without breaching legal requirements.

11. Prize Terms:
    Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash. CW Wines will make reasonable efforts to accommodate recipients’ needs. However, if a recipient cannot be contacted, the prize may be forfeited and an alternative recipient selected. If any part of a prize is cancelled or postponed due to unforeseen circumstances, the Promoter reserves the right to modify or suspend the prize. Prizes will be delivered to Australian addresses only and in accordance with relevant liquor delivery laws. Recipients may be required to show valid ID on delivery. Prizes are for personal use only and must not be resold for commercial gain.
12. No Responsibility for Prize Issues:
    CW Wines is not responsible for any portion of the prize that is not awarded or for additional compensation. No refunds or credits are offered for changes to prizes.
13. Prize Award:
    To determine the winners, all eligible purchasers of a 6-pack of Manly Forever during the Promotional Period will be entered into separate random draws conducted by state and territory. Prizes are allocated per state/territory to ensure compliance with local permit requirements and thresholds. Each winner will receive one signed magnum, valued at $450 AUD (excluding delivery charges). The total prize pool and number of prizes awarded vary by state, with prize breakdowns detailed in Section 31 (State-Specific Prize Allocation and Permits).
14. Invalid Entries:
    Incomplete or indecipherable entries will be deemed invalid.
15. Dispute Resolution:
    In case of a dispute over an entrant’s identity, the Promoter reserves the right to determine the entrant’s identity at its discretion.
16. Winner Notification:
    Winners will be drawn at random using a certified randomisation method. Winners will be notified by email and/or phone within seven (7) days of the draw. The draw will take place at 11:00 AM AEST on 25 August 2025 at CW Wines, 4 Nelson Street, Stepney SA 5069.
17. Winner Publication:
    Winners will be published on the CW Wines website (https://www.cwwines.com/pages/manly-forever) within 7 days of the draw and may also be announced via CW Wines’ official social media platforms.
18. Promoter’s Decision:
    The Promoter’s decision is final, and no correspondence will be entered into.
19. Unclaimed Prize Draw:
    If any prize remains unclaimed after three months, a redraw will take place at the same location on 24 November 2025 at 11:00 AM AEST. The winner(s) will be notified using the original contact details provided.
20. Prize Substitution:
    If a prize (or part of a prize) is unavailable, the Promoter may substitute it with a prize of equal value, subject to any written directions from a relevant regulatory authority.
21. Responsible Consumption:
    The Promoter encourages responsible consumption. Legal-age consumers are advised to follow the National Health & Medical Research Council Australian Alcohol Guidelines, available at www.nhmrc.gov.au.
22. Use of Winner’s Image:
    Entrants consent to the Promoter using their name, likeness, image, and/or voice in the event they win, including for promotional purposes, without remuneration and for an unlimited period.
23. Interference with Promotion:
    If this promotion is interfered with due to any reason beyond the Promoter’s control (e.g., technical issues, fraud), the Promoter reserves the right to disqualify any entrant and/or modify, suspend, or cancel the promotion, subject to regulatory authority directives.
24. Internet Access Cost:
    The cost of accessing the promotional website is the entrant’s responsibility and depends on their internet service provider.
25. Automated Entries Prohibited:
    The use of automated entry software or any mechanical/electronic means to repeatedly enter the promotion is prohibited and will result in disqualification.
26. Liability:
    These Terms and Conditions do not exclude or modify statutory consumer guarantees under the Competition and Consumer Act or other relevant laws. Except for liability that cannot be excluded, the Promoter is not liable for any personal injury, loss, or damage arising from the promotion.
27. Liability Exclusions:
    The Promoter is not liable for any issues arising from technical difficulties, theft, unauthorized access, late or misdirected entries, prize variations, or other uncontrollable factors.
28. Personal Information Collection:
    The Promoter collects personal information (PI) to conduct the promotion and may disclose it to third parties, including agents and prize suppliers. Entry is conditional on providing PI, which will be handled in accordance with the Promoter’s Privacy Policy, available at https://www.cwwines.com/pages/privacy-policy.
29. Marketing Use of Personal Information:
    The Promoter may use PI for marketing purposes unless the entrant opts out.
